User Agreement

1. Service Description

Swicar is a platform for buying and selling used and new vehicles. Users can sell and buy vehicles through Swicar, purchase Swicar Plus or Swicar Pro memberships for additional benefits, and create a business profile.

2. Membership Types

Swicar offers three different types of memberships:

• Standard Membership: Free of charge. Standard members can create 1 ad per year for a duration of 1 month.

• Swicar Plus Membership: A paid membership suitable for individual sellers. With this membership, users can create 3 ads, and as long as their Swicar Plus membership continues, their ads remain active and they gain priority in campaigns.

• Swicar Pro Membership: A paid membership suitable for businesses. With this membership, users can create unlimited ads, post service ads, and create a business profile with a special page.

3. User Responsibilities

• Users must provide accurate and complete information when using the Swicar platform. Providing misleading information constitutes fraud and will be addressed by Swicar.

• Users must use the platform in accordance with the law and comply with platform rules. Accounts of users engaging in illegal activities or attempting fraud may be suspended or completely closed.

4. Swicar’s Responsibilities

• Swicar securely stores users' personal data and takes necessary measures to ensure the uninterrupted provision of the service.

• Swicar does not guarantee the accuracy of the information in the listings. Users are responsible for any inaccuracies in the listing content. Incorrect content will be reviewed based on user reports, and Swicar will take appropriate action.

5. Content Management

• Vehicle information provided by users will be shared with buyers on the vehicle’s sales page.

• Ads uploaded to the platform will be reviewed by Swicar's team and approved ads will be published. In the case of reported incorrect information, Swicar will conduct the necessary review and may remove the ad if needed.

6. Commissions and Fees

• Swicar does not take commissions or fees from vehicle sales between users.

• Swicar only offers advantages through paid memberships. Payment transactions for paid memberships are carried out through Swicar’s Stripe payment system.

7. Platform Use

• Users may not use the Swicar platform for fraud, prohibited activities, or illegal transactions. Accounts may be suspended or closed upon detection of such situations.

• Swicar reserves the right to share user data with the authorities in cases of illegal activities.

8. Complaints and Appeals

• Users can submit complaints or appeals regarding listings or transactions through the notification button on the listing page or by sending an email to [email protected].

9. Relationships with Third Parties

• Swicar collaborates with the payment provider Stripe for user payments. User information shared with Stripe during the purchase of memberships will be used to ensure the secure execution of payments.

10. Legal Obligations

• Swicar is not responsible for transactions between users and does not accept legal responsibility for these transactions.

• This agreement is governed by Swiss law and shall be interpreted under Swiss law.
